Transport Industry Legislation
The Transport Industry has much legislation in place to ensure our roads remain a safe place to be on. It is enforced by the Police and the Driver and Vehicle Standards Agency (DVSA) which is an executive agency within the Department for Transport. The
legislation covers both UK and foreign vehicles.
The Police often have operations run nationally where they select commercial vehicles for examination. If they find any problems with the weight, mechanical operation or the paperwork side of things such as driver’s hours they issue fixed penalties, prohibitions or
report the driver for legal action by the courts or the Traffic Commissioner.
If an offence is deemed to be of a More Serious Infringement (MSI) then a TE may visit the company on an unannounced visit or by appointment to see if the company are following the systems required by an Operator’s License. These systems are designed to ensure
operators keep to the rules and are complying with all the legislation.
The result of this report results in Satisfactory, Mostly Satisfactory, Unsatisfactory score
Satisfactory = This means you have a Green indicator on your OCRS score.
Mostly Satisfactory = You may receive a visit within 3 to 6 months to ensure you have taken the advice given by the TE and actioned the recommendations. This may result in an Amber on your OCRS score.
Unsatisfactory = you will be given 2 weeks to show what action you have taken and what you are taking to correct any items highlighted by the TE. This may result in a RED indicator on the OCRS score. A red indicator will result on your vehicles being stopped by the
DVSA and the Police when they are seen on the road. The colour code will be placed on ANPR which is installed in the DVSA stopping vehicles and it helps the driver identify bad operators and stop the vehicle for checking.
If a company has a driver stopped and infringements found, or they have received notification of a TE visit then DMTC can prepare you and your systems to try and make sure you receive a Satisfactory score from the DVSA.
